O-1 Visas for Extraordinary Ability
The O-1 visa classification is available to foreign nationals who have “extraordinary ability in the sciences, arts, education, business or athletics” which “have been demonstrated by sustained national or international acclaim.” This includes most types of occupations, including Engineers, Doctors, Chefs, Actors, Professional Atheletes and Scientists.
There are certain criteria that USCIS uses to assess whether a Beneficiary qualifies for an O-1 visa. While the Beneficiary must qualify for the visa classification based upon his qualifications, but the occupation does not need to be one which requires the extraordinary ability.
The O-1 Beneficiary must either be petitioned by an employer or if the position is normally the type of position that is self-employed, the petition may be submitted by an agent of the Beneficiary. This visa classification also qualifies for dual-intent.
