L-1 Intracompany Transferee
L-1 visa holders are non-immigrant workers coming to the United States to work for an employer who is related to a company where the worker worked overseas.
L-1 Beneficiaries may be managers, owners and “specialized knowledge” employees who have either a special knowledge of the company’s products or advanced knowledge of the company’s processes and procedures. This visa classification is good for seven years for executives and managers and five years for specialized knowledge employees. The doctrine of dual intent applies to the L-1 classification.
The basic requirements for the L-1 visa classification is that the employee work for the foreign company for at least one of the previous three years. Larger companies may apply for “Blanket L-1 Approval.”
Spouses of L-1 visa holders may apply to work in the United States by submitting an Application for Employment Authorization form to USCIS.
