H-1B Specialty Occupations
Businesses can petition professionals from other nations to work in the United States in Specialty Occupations—those occupations that require:
- A theoretical application of a highly specialized body of knowledge; and
- The attainment of bachelor’s or higher degree (or its equivalent ) in the specific specialty as a minimum for entry into the occupations in the United States.
Typical H-1B occupations include Accountant, Economist, Engineer, Computer Programmer, Attorney and Physician. While many managerial positions qualify as specialty occupations, it takes an experienced immigration to frame the petition. This importance is magnified as the California Service Center of United States Citizenship and Immigration Services (“USCIS”) regularly rejects petitions and occupations as not qualifying under the statute and the regulations.
