Family Petition Via Consular Process
Lawful Permanent Residents and Citizens of the United States may petition for certain family members in another country to enter the United States with an Immigrant Visa and receive a Green Card. These family petitions can be for Immediate Relatives, such as by a United States Citizen for his spouse, parents or minor children, or for different family classifications such as a US Citizen for an adult son or daughter or a US Citizen for a sibling or a Lawful Permanent Resident for Spouse or unmarried son or daughter.
There is no waiting period for Immediate Relative petitions. The processing time is generally less than a year. There are, however, significant waiting periods for each of the other Family Classifications, ranging from just a few years to over twenty-five years. The current priority dates for the four family classifications can be found on the Visa Bulletin published monthly by the US Department of State.
There are several reasons to file a Family Petition, even if it seems that the waiting period is several years. Consult with a well qualified immigration attorney to get the process done right the first time.
